Republic Act 7942, the Mining Act of 1995 or the Exploration, Mining, Quarrying and Processing of Minerals was declared Constitutional by the Supreme Court in 2005, paving the way for foreign companies to have a 100% equity ownership on mining projects.

The National Policy Agenda on Revitalizing Mining in the Philippines or Executive Order 270 was signed into law on January 16, 2004, enjoining various government agencies to support and address the needs of the minerals sector, which contains 12 guiding principles for responsible mining: protection of the environment, equitable sharing of benefits, continuous and meaningful consultation process with the industry and all stakeholders, among others.

The Establishment of Minerals Development Council (MDC) was signed into law on 11 October 2005 as Executive Order 469, which operates under the Office of the President. The MDC has the primary responsibility of advancing the government policy of responsible and sustainable development of the State’s mineral resources.
